Detailed travel terms and conditions

Dear travel guest,

Please pay attention to these detailed travel terms and conditions, because you accept them with your booking. These terms and conditions apply for all services offered by EMIRATES EXCLUSIVE HOTELS (travel agencies) on its websites*.

1. Scope

1.1 The travel agent is specified in the contract documents and on the homepage.

1.2. Emirates Exclusive Hotels is only a travel agency and not a tour operator. The travel services are rendered by tour operators or other service providers. The travel contract is between the traveller and the tour operator/other service provider. The travel agency only takes the reservation and gives it to the tour operator.

1.3. The scope of the service is defined in the notification form or on the basis of the standard terms and conditions of the operator of travel arrangements. The travel agency is not contractually involved in the arranged travel services.

2. Notification / Booking / Travel information

2.1. The notification, which can be made in written form or by electronic means (via e-mail), is a binding order to the travel agency to act as an intermediary in the provision of a travel contract with a supplier of travel arrangements or of other travel and transport services.

2.2. The responsibility of the travel agency is limited to the proper arrangement of travel services. The travel agency isn’t responsible for information about the travel services given from the travel agency to the traveller. The travel agency has no direct contractual liability in connection with the travel arrangements provided by the supplier/operator of travel arrangements.

3. Booking confirmation

3.1. Notifications / Bookings are confirmed by the tour operator or other service provider in writing.

3.2. The traveller has to check the accuracy of the booking conformation. If there are any deviations, the traveller has to point it out immediately to the tour operator or other service provider.

4. Liability of the travel agency

4.1. Details about travel services are based on the information of the tour operator/service provider. The travel agency doesn’t guarantee the correctness, completeness and currentness of the conveyed information.

4.2. The contractual liability of the travel agency arising from its activity as an intermediary for travel arrangements is limited to intent and negligence. Exceptions are damages of life, body or health.

5. Changes / Cancellation

5.1. The traveller can resign from the travel anytime before date of departure. The tour operator can require an adequate compensation. The amount of the compensation depends on the price of the travel less the saved expenses and the possible ulterior application of the benefits.

5.2. The compensation can also be a percentage of the travel price. The amount is written in the terms and conditions of the tour operator.

5.3. Until the commencement of the travel package, the traveller may demand that a third party takes over the rights and duties under the package travel contract in his place. The travel organiser may object to such taking over of the contract by a third party if the third party does not satisfy the specific travel requirements or if the participation of the third party is contrary to statutory regulations or official orders. If a third party takes over the contract, then the third party and the traveller are liable to the travel organiser as joint and several debtors for the travel price and any extra charges incurred by the third party taking over the contract.

5.4. The travel agency recommends the conclusion of a traveller’s cancellation insurance. 

6. Hint for special regulations

6.1. It is your responsibility to ensure that you comply with applicable passport, visa and health requirements and that you procure all necessary documents. The travel agency is not liable for the timely issue and availability of required visas by the applicable diplomatic office. The travel agency can give you information about the regulations but it doesn’t guarantee the correctness, completeness and currentness of the conveyed information.

6.2. The travel agency informs you about the airline you travel with.

6.3. The travel agency isn’t responsible for any conditions of travel concerning the destination.

7. Payment

7.1. You have to pay for your package tour at the moment when you get the certificate of insurance. Other payments have to be made at the latest when you get the travel documents. Deposits can fall due to the moment which is indicated on the booking confirmation.

7.2. If there is a travel service where you don’t need a certificate of insurance, you have to pay after the reservation, at the latest when you get the travel documents.

7.3. Payment can be made by:

7.4. Costs for cancellation, adaption and rebooking have to be paid immediately.

7.5. The travel agency gives you all the documents like tickets, voucher and so on. The travel agency assumes no responsibility for travel documents that are sent to you through the post. The travel agency is not obliged to replace any missing or lost travel documents on a gratuitous basis.

8. Other regulations

8.1. The German law is applies. Court of jurisdiction is Berlin.

8.2. The ineffectiveness of particular regulations does not cause the ineffectiveness of the complete travel agreement. The same is essential for existence of travel conditions. Should one of the preceding regulations be feeble or become feeble, does this not effect the other regulations. The feeble regulation has to be displaced by a regulation that is close to the economic function of the replaced regulation.

8.3. The correction of misprints and apparent miscalculations are subject to alteration.
